This agreement is made between you (as listed above) hereinafter “You”, and Michael Kormos Photography, LLC (dba Twinkle Portraits) hereinafter “Us/We”.
1 ) You may reschedule your Portrait Session once, provided you give us written notice at least 48 hours in advance. Any rescheduling with less than 48 hours notice will incur a $300 fee. This policy is strictly enforced. For outdoor Portrait Sessions: Please be punctual. We try our best to allow for some flexibility. However, if you arrive 20 minutes past your appointment, we will have to reschedule your Portrait Session ($300 rescheduling fee applies).
2 ) Other cameras or video recorders are not allowed at the Portrait Session. Please respect this rule, as it can be distracting to children and prevents us from doing our job to the best of our abilities.
3 ) By purchasing a Retainer, you agree that the remaining balance of your Portrait Session (plus applicable sales tax) will be automatically billed to your credit card upon scheduling. Retainer is non-refundable, and the fee can only be applied towards a Portrait Session. All terms & conditions pertaining to your Portrait Session apply.
4 ) We maintain the right to reschedule the Portrait Session appointment due to inclement weather or personal emergency.
5 ) In the unlikely event of a hardware failure, loss, or theft of our equipment, we are not responsible for any images lost or stolen. In such an event, we will issue you a full refund.
PRODUCTS & ORDERING
6 ) Digital images will be available for download approximately 2-3 weeks after your Portrait Session.
7 ) Once you place an order for Prints or additional products, no refunds or exchanges are offered. Due to the custom nature of our products, they are sold “as-is” without warranty of any kind. Once you place an order, it may not be modified or canceled. If an item arrives damaged, you must notify us in writing within 48 hours of its receipt. Certain color and tonal variation occur with all printed products.
8 ) Creative privilege: As the artists, we use our artistic discretion to carefully select the final images, edit portraits in our signature style, and crop images for prints and products. We do not release raw, unedited images, since these are not a finished product.

10 ) Print Credit and tangible products are subject to applicable sales tax. All sales are final and non-refundable. By placing an order, you agree that you have fully read and understood all product descriptions as listed on our website.
WAIVER & COPYRIGHT
You release Michael Kormos Photography, LLC and its employees & contractors from all claims, damages, and liabilities that may result from accidents or incidents that occur during the Session. We retain our own, sole and exclusive copyright to all images (including digital images). Your use of these images is limited to personal, non-commercial purposes, and you may not sell or assign these images to a third party. Furthermore, you release and discharge us from any and all claims and demands ensuing from or in connection with the use of the images, including any and all claims for libel and invasion of privacy. This authorization and release shall inure to the benefit of the legal representatives, licensees and assignees of Michael Kormos Photography, LLC.
